Criminal Actions Against A Person Who Posts Nude Photos Of Ex-Girlfriend

Some people use technology to make lives easier and more convenient while others choose to abuse it. As social networking sites remain popular to all ages, they are also used for blackmailing victims. One of which is posting nude photos of a hapless victim and the perpetrator will only take it down if the victim will give in to their demands. Some victims will choose to nod along with whatever they are told to do for fear of humiliation. However, there are cases that you can file under Republic Act 9262. 

Anti-Violence Against Women and Their Children Act of 2004

SECTION 5. Acts of Violence Against Women and Their Children.- The crime of violence against women and their children is committed through any of the following acts:

(a) Causing physical harm to the woman or her child;

(b) Threatening to cause the woman or her child physical harm; 

(c) Attempting to cause the woman or her child physical harm;

(d) Placing the woman or her child in fear of imminent physical harm;

(e) Attempting to compel or compelling the woman or her child to engage in conduct which the woman or her child has the right to desist from or desist from conduct which the woman or her child has the right to engage in, or attempting to restrict or restricting the woman's or her child's freedom of movement or conduct by force or threat of force, physical or other harm or threat of physical or other harm, or intimidation directed against the woman or child. This shall include, but not limited to, the following acts committed with the purpose or effect of controlling or restricting the woman's or her child's movement or conduct:

(1) Threatening to deprive or actually depriving the woman or her child of custody to her/his family;

(2) Depriving or threatening to deprive the woman or her children of financial support legally due her or her family, or deliberately providing the woman's children insufficient financial support;

(3) Depriving or threatening to deprive the woman or her child of a legal right; and 

(4) Preventing the woman in engaging in any legitimate profession, occupation, business or activity or controlling the victim's own money or properties, or solely controlling the conjugal or common money, or properties.

(f) Inflicting or threatening to inflict physical harm on oneself for the purpose of controlling her actions or decisions;

(g) Causing or attempting to cause the woman or her child to engage in any sexual activity which does not constitute rape, by force or threat of force, physical harm, or through intimidation directed against the woman or her child or her/his immediate family;

(h) Engaging in purposeful, knowing, or reckless conduct, personally or through another, that alarms or causes substantial emotional or psychological distress to the woman or her child. This shall include, but not be limited to, the following acts:

(1) Stalking or following the woman or her child in public or private places;

(2) Peering in the window or lingering outside the residence of the woman or her child;

(3) Entering or remaining in the dwelling or on the property of the woman or her child against her/his will;

(4) Destroying the property and personal belongings or inflicting harm to animals or pets of the woman or her child; and

(5) Engaging in any form of harassment or violence.

(i) Causing mental or emotional anguish, public ridicule or humiliation to the woman or her child, including, but not limited to, repeated verbal and emotional abuse, and denial of financial support or custody of minor children of access to the woman's child/children.

What Are The Crimes Against Persons In Authority And Their Agents

Recent news involving persons in authority or public officers clouded people's mind with doubts, questioning the credibility of individuals who are supposed to maintain peace and order. However, perpetrators resisting arrest and disobeying authorities are as prevalent as public officers employing force. The Revised Penal Code gives details on crimes against persons in authority. 

ASSAULT UPON, AND RESISTANCE AND DISOBEDIENCE

TO, PERSONS IN AUTHORITY AND THEIR AGENTS

Art. 148. Direct assaults. — Any person or persons who, without a public uprising, shall employ force or intimidation for the attainment of any of the purpose enumerated in defining the crimes of rebellion and sedition, or shall attack, employ force, or seriously intimidate or resist any person in authority or any of his agents, while engaged in the performance of official duties, or on occasion of such performance, shall suffer the penalty of prision correccional in its medium and maximum periods and a fine not exceeding P1,000 pesos, when the assault is committed with a weapon or when the offender is a public officer or employee, or when the offender lays hands upon a person in authority. If none of these circumstances be present, the penalty of prision correccional in its minimum period and a fine not exceeding P500 pesos shall be imposed.

Art. 149. Indirect assaults. — The penalty of prision correccional in its minimum and medium periods and a fine not exceeding P500 pesos shall be imposed upon any person who shall make use of force or intimidation upon any person coming to the aid of the authorities or their agents on occasion of the commission of any of the crimes defined in the next preceding article.

Art. 150. Disobedience to summons issued by the National Assembly, its committees or subcommittees, by the Constitutional Commissions, its committees, subcommittees or divisions. — The penalty of arresto mayor or a fine ranging from two hundred to one thousand pesos, or both such fine and imprisonment shall be imposed upon any person who, having been duly summoned to attend as a witness before the National Assembly, (Congress), its special or standing committees and subcommittees, the Constitutional Commissions and its committees, subcommittees, or divisions, or before any commission or committee chairman or member authorized to summon witnesses, refuses, without legal excuse, to obey such summons, or being present before any such legislative or constitutional body or official, refuses to be sworn or placed under affirmation or to answer any legal inquiry or to produce any books, papers, documents, or records in his possession, when required by them to do so in the exercise of their functions. The same penalty shall be imposed upon any person who shall restrain another from attending as a witness, or who shall induce disobedience to a summon or refusal to be sworn by any such body or official.

Art. 151. Resistance and disobedience to a person in authority or the agents of such person. — The penalty of arresto mayor and a fine not exceeding 500 pesos shall be imposed upon any person who not being included in the provisions of the preceding articles shall resist or seriously disobey any person in authority, or the agents of such person, while engaged in the performance of official duties.

When the disobedience to an agent of a person in authority is not of a serious nature, the penalty of arresto menor or a fine ranging from 10 to P100 pesos shall be imposed upon the offender.

Art. 152. Persons in authority and agents of persons in authority; Who shall be deemed as such. — In applying the provisions of the preceding and other articles of this Code, any person directly vested with jurisdiction, whether as an individual or as a member of some court or governmental corporation, board, or commission, shall be deemed a person in authority. A barrio captain and a barangay chairman shall also be deemed a person in authority.

A person who, by direct provision of law or by election or by appointment by competent authority, is charged with the maintenance of public order and the protection and security of life and property, such as a barrio councilman, barrio policeman and barangay leader and any person who comes to the aid of persons in authority, shall be deemed an agent of a person in authority.

In applying the provisions of Articles 148 and 151 of this Code, teachers, professors and persons charged with the supervision of public or duly recognized private schools, colleges and universities, and lawyers in the actual performance of their professional duties or on the occasion of such performance, shall be deemed persons in authority. (As amended by PD No. 299, Sept. 19, 1973 and Batas Pambansa Blg. 873, June 12, 1985). 

Grounds For Awarding Moral Damages

There are different kinds of damages based on the principles of general law and the most common is moral damage. Someone whose reputation has been tainted due to wrong accusations would cry foul and moral damage will be awarded with sufficient evidence. There are many situations that moral damages may be recovered. 

Moral Damages

ARTICLE 2217. Moral damages include physical suffering, mental anguish, fright, serious anxiety, besmirched reputation, wounded feelings, moral shock, social humiliation, and similar injury. Though incapable of pecuniary computation, moral damages may be recovered if they are the proximate result of the defendant's wrongful act for omission.

ARTICLE 2218. In the adjudication of moral damages, the sentimental value of property, real or personal, may be considered.

ARTICLE 2219. Moral damages may be recovered in the following and analogous cases:

(1) A criminal offense resulting in physical injuries;

(2) Quasi-delicts causing physical injuries;

(3) Seduction, abduction, rape, or other lascivious acts;

(4) Adultery or concubinage;

(5) Illegal or arbitrary detention or arrest;

(6) Illegal search;

(7) Libel, slander or any other form of defamation;

(8) Malicious prosecution;

(9) Acts mentioned in article 309;

(10) Acts and actions referred to in articles 21, 26, 27, 28, 29, 30, 32, 34, and 35. 

The parents of the female seduced, abducted, raped, or abused, referred to in No. 3 of this article, may also recover moral damages.

The spouse, descendants, ascendants, and brothers and sisters may bring the action mentioned in No. 9 of this article, in the order named.

ARTICLE 2220. Willful injury to property may be a legal ground for awarding moral damages if the court should find that, under the circumstances, such damages are justly due. The same rule applies to breaches of contract where the defendant acted fraudulently or in bad faith.

Blocking Adult Websites As The First Step To Combating Child Pornography

Adults get a visual treat where they can feast their eyes on epic proportions from virtual adult Disneyland often referred to as porn sites. Yes, you will be greeted with an all-you-can eat buffet palatable to your senses. They are the sights to behold to some, but definitely not a form of entertainment for the squeamish. However, sex predators are also using these sites to feed their insatiable appetite. The government has taken the first step to curbing child pornography, as stipulated in Republic Act 9775 or the Anti-Child Pornography Law. Back in 2014, similar efforts were made by the National Telecommunications Commission of the Philippines. In a recent study, it has been revealed that the Philippines spent the most time on porn sites.  At this point, there are experts who are still skeptical about the effort, but the results are still unclear unless you start looking through the lens. 

Anti-Child Pornography Law

Section 4. Unlawful or Prohibited Acts. – It shall be unlawful for any person:

(a) To hire, employ, use, persuade, induce or coerce a child to perform in the creation or production of any form of child pornography;

(b) To produce, direct, manufacture or create any form of child pornography;

(c) To publish offer, transmit, sell, distribute, broadcast, advertise, promote, export or import any form of child pornography;

(d) To possess any form of child pornography with the intent to sell, distribute, publish, or broadcast: Provided. That possession of three (3) or more articles of child pornography of the same form shall be prima facie evidence of the intent to sell, distribute, publish or broadcast;

(e) To knowingly, willfully and intentionally provide a venue for the commission of prohibited acts as, but not limited to, dens, private rooms, cubicles, cinemas, houses or in establishments purporting to be a legitimate business;

(f) For film distributors, theaters and telecommunication companies, by themselves or in cooperation with other entities, to distribute any form of child pornography;

(g) For a parent, legal guardian or person having custody or control of a child to knowingly permit the child to engage, participate or assist in any form of child pornography;

(h) To engage in the luring or grooming of a child;

(i) To engage in pandering of any form of child pornography;

(j) To willfully access any form of child pornography;

(k) To conspire to commit any of the prohibited acts stated in this section. Conspiracy to commit any form of child pornography shall be committed when two (2) or more persons come to an agreement concerning the commission of any of the said prohibited acts and decide to commit it; and

(l) To possess any form of child pornography.

Section 5. Syndicated Child Pornography – The crime of child pornography is deemed committed by a syndicate if carried out by a group of three (3) or more persons conspiring or confederating with one another and shall be punished under Section 15(a) of this Act.

Section 6. Who May File a Complaint. – Complaints on cases of any form of child pornography and other offenses punishable under this Act may be filed by the following:

(a) Offended party;

(b) Parents or guardians;

(c) Ascendant or collateral relative within the third degree of consanguinity;

(d) Officer, social worker or representative of a licensed child-caring institution;

(e) Officer or social worker of the Department of Social Welfare and Development (DSWD);

(f) Local social welfare development officer;

(g) Barangay chairman;

(h) Any law enforcement officer;

(i) At least three (3) concerned responsible citizens residing in the place where the violation occurred; or

(j) Any person who has personal knowledge of the circumstances of the commission of any offense under this Act.

Abused Women And Their Children: Not Waving But Drowning

Many women cry(or even die) in silence and the bruises all over their body are tell tale signs of domestic abuse. According to the Center for Women's Resources (CWR), from year 2010 and 2014, the violations of the Anti-Violence Against Women and Children Act increased by 200 percent.  In a country where male dominance is still considered part of the culture, some women remain submissive despite the pain they have to endure. Victims of domestic violence continue to be in chains because of giving importance to the sanctity of marriage. Women who are abused also stay for the sake of their children, but the trauma continues as children would sometimes witness the physical and emotional torture being inflicted upon the mother. In fact, children are not spared from violence because their frail body is also used as punching bag when the father has temper tantrums. Unfortunately, violence is not limited to physical abuse. So, what are considered acts of violence against women and their women.

SEC. 5. Acts of violence against women and their children under R.A. No. 9262.—Violence against women and their children is committed through any of the following acts:

(a)            Causing, threatening or attempting to cause physical harm to the woman or her child;

(b)            Placing the woman or her child in fear of imminent physical harm;

(c)            Attempting to compel or compelling the woman or her child to engage in conduct which the woman or her child has the right to desist from or to desist from conduct which the woman or her child has the right to engage in, or attempting to restrict .or restricting the woman’s or her child’s freedom of movement or conduct by force or threat of force, physical or other harm or threat of physical on other harm, or intimidation directed against the woman or her child.

This shall include, but is not limited to, the following acts committed with the purpose or effect of controlling or restricting the movement or conduct of the woman or her child:

(1)     Threatening to deprive or actually depriving the woman or her child of custody or access to her/his family;

(2)     Depriving or threatening to deprive the woman or her children of financial support legally due her or her family, or deliberately providing the woman’s children insufficient financial support;

(3)     Depriving or threatening to deprive the woman or her child of a legal right; and

(4)     Preventing the woman from engaging in any legitimate profession, occupation, business or activity except in cases where the spouse or partner on valid, serious  and moral grounds, or controlling the victim’s own money or property, or solely controlling the conjugal or common money or property;

(d)            Inflicting or threatening to inflict physical ham on oneself for the purpose of controlling her actions or decisions;

(e)            Causing or attempting to cause the woman or her child to engage in any sexual activity which does not constitute rape, by force or threat of force, physical harm, or through intimidation directed against the woman   or her child or her/his immediate family;

(f)             Engaging in purposeful, knowing, or reckless conduct, personally or through another, that alarms or causes substantial emotional or psychological distress to the woman or her child.

This shall include, but is not limited to, the following acts:

(1)     Stalking or following the woman or her child in public or private places;

(2)     Peering in the window or lingering outside the residence of the woman or her child;

(3)     Entering or remaining in the dwelling or on the property of the woman or her child against her/his will;

(4)     Destroying the property and personal belongings or inflicting harm to animals or pets of the woman or child; and

(5)     Engaging in any form of harassment or violence; or

(g)            Causing mental or emotional anguish, public ridicule or humiliation to the woman or her child, including, but not limited to, repeated verbal and emotional abuse, and denial of financial support or custody of a minor child or denial of access to the woman’s child.

Reasons For A Mother To Lose Child Custody

In general, the full custody of a child below seven is given to the mother. However, a mother may risk losing custody if found guilty of subjecting children to any type of abuse.

The compelling reasons for a mother to lose child custody:

1. insanity
2. neglect
3. abandonment
4. immorality and unemployment
5. habitual drunkenness
6. drug addiction
7. maltreatment of the child
8. affliction with a communicable illness

For children older than seven years of age, they have the right to state their preference. However, the court is not bound by the children's choice as it also has to exercise its discretion by ensuring that the parent who gets the custody is deemed fit for the role. The custody may also be given to a third person.

"Art. 209. Pursuant to the natural right and duty of parents over the person and property of their unemancipated children, parental authority and responsibility shall include the caring for and rearing them for civic consciousness and efficiency and the development of their moral, mental and physical character and well‑being. (n)

The State ought not to interfere with the right of parents to bring up their child unless its exercise causes potential harm to him. The State steps in, through the law, only if there are compelling reasons to do so. State intrusion is uncalled for where the welfare of a child is not jeopardized.

Regardless of marital circumstances, the mother and the father are presumed to be fit and competent to act in the best interest of their child. They can agree to share parental authority or, if you will, parental custody even as they decide to live under separate roofs. In a voluntary joint custody the mother might want to keep the child in her home during schooldays but allow the father to have him on weekends. And they could agree on some device for arriving at a consensus on where the child will study and how his spiritual needs are to be attended to.

The law does not take away from a separating couple the authority and competence to determine what is best for their child. If they resolve on their own that shared parental custody is in their child's best interest, then the law and the courts have no business vetoing their decision. The parents enjoy a primary right to make such decision. I cannot concede that, where the child is below seven years of age, any agreement that diminishes the mothers absolute custody over him is void.

The second paragraph of Article 213 of the Family Code should not be read as prohibiting separated couples from agreeing to a custody arrangement, other than sole maternal custody, for their child of tender age. The statutory preference for the mothers custody comes into play only when courts are compelled to resolve custody fights between separated parents. Where the parents settle the matter out of court by mutual agreement, the statutory preference reserved to the mother should not apply.

A reading of the entire text of Article 213 shows that the second paragraph applies only to custody disputes that have reached the courtroom. Thus:

Article 213. In case of separation of the parents, parental authority shall be exercised by the parent designated by the Court. The Court shall take into account all relevant considerations, especially the choice of the child over seven years of age, unless the parent chosen is unfit.

No child under seven years of age shall be separated from the mother, unless the court finds compelling reasons to order otherwise.

It is unmistakable that the legislative policy is to vest the separated mother with physical custody of the child under seven years old, in cases where the courts are called upon to designate a parent for the exercise of parental authority. The second sentence of the first paragraph and the second paragraph itself merely qualify the general rule expressed in the first sentence that parental authority shall be exercised by the parent designated by the Court, in case of parental separation.

In choosing the parent who will exercise parental authority, the court must take into account all relevant considerations. One of these is the child's age, as the court is directed to give due regard to the child's choice, if the child is more than seven years of age. If the child, however, is below seven years of age, the court cannot separate the child from the mother, except for compelling reasons. This is the import of the entire provision.

Thus, no legislative policy is violated if separated parents are allowed to voluntarily agree to a child custody arrangement other than sole maternal custody. It is not the policy of the state to prohibit separated parents from compromising on child custody even if the child is of tender age. On the contrary, voluntary custody agreements are generally favored as it can only work for the best interest of the child.

It is not logical to say that the Court would be subverting the legislative policy of avoiding a tragedy where a mother has seen her baby torn away from her if separated parents are allowed to enter into a joint custody agreement. It can hardly be said that a child is being torn away from the mother, if the mother sees the wisdom and benefit of sharing custody of the child with the father. The voluntary nature of the agreement negates any deep sorrow or sense of deprivation that the mother may experience on account of her separation from the child."

Threats And Coercion: Crimes Against Security

There are instances when we demand for money or another condition, but when these demands are not fulfilled, there is a tendency for the person who made a demand to pose a threat out of frustration. To some, it may just be a way of reminding the person to fulfil the demands, but if such threats have already disturbed the peace of mind of an individual, even if the person who made the demand intended no harm, this can still be considered as a crime against security. Threats and coercion have a broad spectrum, but one thing is for sure, a declaration to harm a person in the throes of anger can still be considered as a form of threat.  

“Article 282. Grave threats. - Any person who shall threaten another with the infliction upon the person, honor or property of the latter or of his family of any wrong amounting to a crime, shall suffer:

1. The penalty next lower in degree than that prescribed by law for the crime be threatened to commit, if the offender shall have made the threat demanding money or imposing any other condition, even though not unlawful, and said offender shall have attained his purpose. If the offender shall not have attained his purpose, the penalty lower by two degrees shall be imposed.

If the threat be made in writing or through a middleman, the penalty shall be imposed in its maximum period.

2. The penalty of arresto mayor and a fine not exceeding 500 pesos, if the threat shall not have been made subject to a condition.
Article 283. Light threats. - Any threat to commit a wrong not constituting a crime, made in the manner expressed in subdivision 1 of the next preceding article, shall be punished by arresto mayor.

Article 284. Bond for good behavior. - In all cases falling within the two next preceding articles, the person making the threats may also be required to give bail not to molest the person threatened, or if he shall fail to give such bail, he shall be sentenced to destierro.

Article 285. Other light threats. - The penalty of arresto menor in its minimum period or a fine not exceeding 200 pesos shall be imposed upon:

1. Any person who, without being included in the provisions of the next preceding article, shall threaten another with a weapon or draw such weapon in a quarrel, unless it be in lawful self-defense.

2. Any person who, in the heat of anger, shall orally threaten another with some harm not constituting a crime, and who by subsequent acts show that he did not persist in the idea involved in his threat, provided that the circumstances of the offense shall not bring it within the provisions of Article 282 of this Code.

3. Any person who shall orally threaten to do another any harm not constituting a felony.

Article 286. Grave coercions. - The penalty of arresto mayor and a fine not exceeding 500 pesos shall be imposed upon any person who, without authority of law, shall, by means of violence, prevent another from doing something not prohibited by law, or compel him to do something against his will, whether it be right or wrong.

If the coercion be committed for the purpose of compelling another to perform any religious act or to prevent him from so doing, the penalty next higher in degree shall be imposed.

Article 287. Light coercions. - Any person who, by means of violence, shall seize anything belonging to his debtor for the purpose of applying the same to the payment of the debt, shall suffer the penalty of arresto mayor in its minimum period and a fine equivalent to the value of the thing, but in no case less than 75 pesos.

Any other coercions or unjust vexations shall be punished by arresto menor or a fine ranging from 5 pesos to 200 pesos, or both.

Article 288. Other similar coercions; (Compulsory purchase of merchandise and payment of wages by means of tokens.) - The penalty of arresto mayor or a fine ranging from 200 to 500 pesos, or both, shall be imposed upon any person, agent or officer, of any association or corporation who shall force or compel, directly or indirectly, or shall knowingly permit any laborer or employee employed by him or by such firm or corporation to be forced or compelled, to purchase merchandise or commodities of any kind.

The same penalties shall be imposed upon any person who shall pay the wages due a laborer or employee employed by him, by means of tokens or objects other than the legal tender currency of the laborer or employee.”

When Does An Individual Commit The Crime Of Acts Of Lasciviousness?

Living in a conservative country such as the Philippines feels as though you are walking on eggshells as you need to be very careful with your actions. For instance, making a physical contact would mean an innocuous gesture to some, but a serious offense to others. It may seem very subjective, but the crime of acts of lasciviousness is already a serious mater and this is when touching means something. However, many choose to keep silent because in a country where sex is a taboo topic, some victims are the ones being blamed for the crime committed. Like rape, acts of lasciviousness can be very traumatic to the hapless victim and it is not just about sex but taking advantage of the victim’s weakness. So what exactly are acts of lasciviousness?

As defined in the Republic Act No. 7610, “Lascivious conduct” means the intentional touching, either directly or through clothing, of the genitalia, anus, groin, breast, inner thigh, or buttocks, or the introduction of any object into the genitalia, anus or mouth, of any person, whether of the same or opposite sex, with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person, bestiality, masturbation, lascivious exhibition of the genitals or public area of a person.”

Elements of the Crime of Acts of Lasciviousness

“1. The accused commits the act of sexual intercourse or lascivious conduct.

2. The said act is performed with a child exploited in prostitution or subjected to sexual abuse.

3. The child, whether male or female, is below 18 years of age.”

Attempted Rape Versus Acts Of Lasciviousness

"Like rape, the acts of lasciviousness are committed by intimidation or force, grave abuse of authority or fraudulent machinations. The victim is deprived of reason, unconscious, demented or under 12 years of age. The offended party in both rape and acts of lasciviousness can be a person of either sex.

However, the act will be considered as an attempted or frustrated rape if the offender clearly demonstrated that his purpose for performing the act is to lie with the offended woman. Lascivious acts are deemed preparatory acts in case of attempted rape. On the other hand, acts of lasciviousness are considered as the offender’s final objective. If the offender does not intend to have sexual intercourse, it will not be considered to be attempted rape. "

If the victim is under 12, it is child abuse under Republic Act No. 7610 and the penalty is one degree higher. Under Art. 339, acts of lasciviousness with the offended party’s consent are committed against a female under circumstance of seduction. Under Art. 336 Acts of lasciviousness are committed against a male or a female under the circumstance of rape.

In a country where Catholics made up the majority of the population, the priests and other religious leaders often become a moral compass and the proverbial principle: see no evil, hear no evil, speak no evil is tailored to what the priests project.  However, a moral compass can still spin wildly and be out of control. While Padre Damaso is deemed a figment of Jose Rizal’s imagination, any news of sexual abuse involving priests will sure remind you of this fictional character’s omnipresence.  

A few weeks ago, sexual abuse cases involving priests have surfaced and they were made more interesting when 2016 presidential aspirant Rodrigo Duterte claimed he was also sexually abused. The sexual abuse cases are a ticking time bomb waiting to explode. Aside from Duterte, a former student breaks his silence after 30 years and he said he was sexually abused from 1984 to 1987. Without a doubt, the alleged victim dropped a bombshell. 

The country embraces religious diversity as it is also home to various religious sectors, but Roman Catholics are the most vocal when it comes to issues they consider to be a violation of their so-called moral standards. They are against RH bill, abortion and god-knows-what-else. Unfortunately, discovering Jesuits involved in sexual abuse scandal is indeed a living mockery and avid followers just keep a stiff upper lip while the issue is still being investigated. While this case does not put you into situation where you will be damned if you do and you will still be damned if you don't, the society has the right to know the truth. In the past, cases of sexual abuse have never been put on record, but there are already reported cases in 2002 according to Wikipedia. The Society of Jesus in the Philippines has yet to conduct an investigation on the abuses. 

If proven guilty, the Jesuits involved in sexual abuse scandal commit a violation of Republic Act 7610 or better known as the Special Protection of Children Against Abuse, Exploitation and Discrimination Act. 

“Sec. 5. Child Prostitution and Other Sexual Abuse. - Children, whether male or female, who for money, profit, or any other consideration or due to the coercion or influence of any adult, syndicate or group, indulge in sexual intercourse or lascivious conduct, are deemed to be children exploited in prostitution and other sexual abuse.

The penalty of reclusion temporal in its medium period to reclusion perpetua shall be imposed upon the following:

(a) Those who engage in or promote, facilitate or induce child prostitution which include, but are not limited to, the following:

(1) Acting as a procurer of a child prostitute;

(2) Inducing a person to be a client of a child prostitute by means of written or oral advertisements or other similar means;

(3) Taking advantage of influence or relationship to procure a child as prostitute;

(4) Threatening or using violence towards a child to engage him as a prostitute; or

(5) Giving monetary consideration goods or other pecuniary benefit to a child with intent to engage such child in prostitution.

(b) Those who commit the act of sexual intercourse of lascivious conduct with a child exploited in prostitution or subject to other sexual abuse; Provided, That when the victims is under twelve (12) years of age, the perpetrators shall be prosecuted under Article 335, paragraph 3, for rape and Article 336 of Act No. 3815, as amended, the Revised Penal Code, for rape or lascivious conduct, as the case may be: Provided, That the penalty for lascivious conduct when the victim is under twelve (12) years of age shall be reclusion temporal in its medium period; and

(c) Those who derive profit or advantage therefrom, whether as manager or owner of the establishment where the prostitution takes place, or of the sauna, disco, bar, resort, place of entertainment or establishment serving as a cover or which engages in prostitution in addition to the activity for which the license has been issued to said establishment.”

Strange Laws You Never Knew Existed: Part 6 Of 15 Criminal Liability Of Rape Is Extinguished Through Marriage

When a man is liable for a crime of rape, forgiveness can be obtained through marriage. This can be found in Article 266 of the Anti-Rape Law of 1997 or the Republic Act No. 8353. Now, if your head is in the clouds, let us first take a good look at what the Anti-Rape Law of 1997 is all about. 

Chapter 3, Article 266-A defines when and how a crime of rape is committed. 

1. By a man who shall have carnal knowledge of a woman under any of the following circumstances:

a. Through force, threat, or intimidation;

b. When the offended party is deprived of reason or otherwise unconscious;

c. By means of fraudulent machination or grave abuse of authority; and

d. When the offended party is under twelve (12) years of age or is demented, even though none of the circumstances mentioned above be present. 

Pardon or forgiveness can be given to the offender once marriage takes place. Under Article 266-C, Effect of Pardon, in case it is the legal husband who is the offender, the subsequent forgiveness by the wife as the offended party shall extinguish the criminal action or the penalty: Provided, that the crime shall not be extinguished or the penalty shall not be abated if the marriage is void ab initio.

With this law, it is a case of forgive and forget. Unfortunately, forgiveness can be elusive especially when the criminal act has left a very deep wound, that scars become a reminder of such an unpleasant experience. As they say, it is easier said than done. 

Rape becomes a violent crime not only because of the force applied but also due to the fact that sexual act is committed against the will of the offended party. The problem with this law is that it sets aside other issues associated with rape. One important point is missing and the fact that a vast range of abuses such as physical, psychological and sexual can take place over a period of time while the offender and the offended party are living under one roof makes the law more open to question. 

Women who are victims of rape become held prisoner of repeated abuse and violence. Marriage only makes the situation worse for women by allowing them to be trapped in such a vicious cycle. Rape victims are traumatized and have difficulty coping. Filing criminal charges against their offenders is difficult let alone marrying the offender.  Sadly, myths about rape have not yet been completely debunked. 

The Criminal Law On Abortion

In a country where moral standards are high, the mere mention of abortion is considered a taboo topic. There are mixed views on abortion, but most of which are against the idea of legalizing the act. If a medical practitioner is found guilty of carrying out abortion, he or she has to face criminal charges. 

Not only does the Philippine law deter women from considering abortion but religious sectors as well. Is it really about time law makers consider the merits of legalizing abortion? 

There are countries that are still not open to the legalization of abortion, and Philippines is one of them. Due to the social stigma, women resort to self-induced abortion, which is considered unsafe and dangerous. 

There are cases when abortion is considered necessary especially if the pregnant woman’s health is at risk. For instance, ectopic pregnancy requires surgery as a means of saving a woman’s life. So long as therapeutic abortion is banned in the country, more and more women continue to subject themselves to dangerous measures. 

For instance, pregnant women who are well aware of the criminal law on abortion refuse to be hospitalized for the fear of getting imprisoned if found that they have undergone unsafe abortion. This is why there is a dramatic increase in the number of women who choose to risk their health and lives.

These women continue to receive moral punches and will be stigmatized for the rest of their lives because of the country’s legal and moral boundaries.

Other countries allow therapeutic abortion when:

• pregnancy is the result of incest or rape;

• the pregnant woman suffers from a medical condition that is life or health threatening such as eclampsia, diabetes, hypertension and cancer. 

• pregnancy is at risk of fetal impairment causing the baby to develop mental or physical defects or die after birth.

Under the Philippine law, abortion has been considered a crime since 1930. Whether abortion is intentional or unintentional, anyone who carries out abortion is said to commit the crime. Even physicians and midwives who perform abortions in the Philippines may be charged of a crime, which can result in six years in prison under the Revised Penal Code. They are still going to be subject for criminal punishments. These are also supplemented by separate laws, prescribing sanctions if medical practitioners including doctors, pharmacists and midwives participated in the process of abortion.

Legalizing abortion in the Philippines is far from happening as there are still various factors that need to be taken into consideration. While the country is still firm in banning abortion, women will continue to endure life-threatening pregnancies and resort to measures that deviate from the medical standards.

An Overview Of Republic Act No. 10627 Anti-Bullying Act

With the pervasiveness of bullying at schools, more and more parents are concerned about their children’s safety since teachers are not always present to keep an eye on students. Children are not safe from harm against bullies especially when they are outside of the school’s premise. The growing number of bullying cases is already a cause for alarm. The Republic Act No. 10627 or also known as the Anti Bullying Act of 2013 addresses this concern among parents, teachers and even students who are considered victims of bullying. The anti-bullying act ensures that these cases will no longer fall on deaf ears. 

What is bullying?

Bullying refers to any repeated or severe use by one or more students of a verbal, electronic or written expression, or a physical gesture or act that can bring physical or emotional harm to the victim. Bullying is also perceived as creating an unfriendly environment for the other student that can cause disruption in the education process. 

The following is considered acts of bullying: 

a. Any unwanted physical contact between the victim and the bully such as pushing, shoving punching, tickling, headlocks, slapping, teasing, fighting, inflicting school pranks and the use of available objects or weapons;

b. Any act that can create damage to a victim’s emotional well-being;

c. Any accusation that can make the victim emotionally distressed such as profanity, foul language, negative comments or derogatory remarks on the victim’s appearance, body and clothes; and 

d. Cyber-bullying or any type of bullying that is initiated with the use of technology or any electronic means. 

Procedures and strategies for bullying:

• Report acts of bullying;

• Respond in a timely manner and investigate reports of bullying;

• Ensure victim’s safety and assess if they need additional protection;

• Provide counseling and other necessary services for the victims, perpetrators and family members.

• Allow students to anonymously report bullying provided, that no disciplinary administrative action will be taken against the reported student based       solely on the anonymous report;

• Provide sanction to a student who makes false accusation of bullying;

• Educate students on the anti-bullying policies and dynamics of bullying;

• Educate parents and guardians about the anti-bullying polices, dynamics of bullying and how parents and guardians can provide support and reinforce policies at home; and

• Keep a public record of statistics and relevant information on acts of bullying. However, the names of the students who were reported to have committed the acts of bullying must be treated with confidentiality and will only be made available to the teachers and school administration that are directly responsible for the said students and parents or guardians of the victims of bullying.
